According to the recently issued press release regarding this settlement, the employers had discriminated against women in their hiring practices and had failed to provide women with proper training and toilet facilities.

The complaint was filed by eight farm workers who reportedly came forward after they were fired by Alsace Co. LP for repeatedly requesting a second bathroom for women. At the time:

  • There had only been one portable toilet for two work crews, including both men and women.
  • The manager of the Alsace vineyard had open expressed his policy of only hiring men and had explicitly told the foreman that either the men or women would have to leave when requests were made to add another bathroom.
  • The women were fired after they refused to leave and made a subsequent request for a bathroom.

Compounding this case was the fact that no anti-discrimination training had been provided to the workers.

The Terms of the Settlement

In addition to paying the sum of $65,000, the employers in this case have also agreed to:

  • Change their hiring policies to be more inclusive of women
  • Report regularly to the DFEH on all new hires over the next three (3) years
  • Train all staff on anti-discrimination and retaliation laws
  • Provide adequate toilet (and other) facilities for women workers.

Commenting on this settlement DFEH Director Kevin Kish stated:

When farmworkers in California’s multibillion dollar agricultural industry labor in unlawful conditions, it is of extreme concern to the Department, which is charged with protecting the people of California from employment, housing and public accommodations discrimination… Many farmworkers who lack formal education and English-language skills are unaware of their rights under the law and are reluctant to demand better working conditions, fearing that their demands will lead to their firing… This is what happened in this case. We are gratified that this group of farmworkers came forward and we were able to negotiate a just resolution.
