According to California Law, overtime pay that is 1.5 times a worker’s regular pay rate is due to that worker when he works more than:

  • 8 hours in a single day
  • 40 hours in a single week.

Here it’s important to note that overtime pay is not the same as double time pay, as double time pay:

  • Doubles a worker’s standard pay rate
  • Applies when employees work in excess of 12 hours in a single day or in excess of 8 hours on the seventh (7th) consecutive day of work.

Common Overtime Payment Issues

Despite California laws governing overtime and double time pay, there are some complications that commonly arise with this type of compensation for workers, especially when it comes to

  • Salaried workers – When workers are salaried, they do NOT lose their rights to overtime pay, according to California law. As with hourly earners, salaried workers are also entitled to overtime pay at a rate that is at least 1.5 times their standard hourly rate for work exceeding the 40-hour work week.So, for instance, if a salaried employee works 55 hours in a given week, his salary has only compensated him for 40 hours of work; by California law, that employee would then be entitled to 1.5 times his hourly rate (which can be computed based on the worker’s weekly earnings) for the remaining 15 hours.
  • Waivers of overtime or double time pay – In some cases, employers may try to restrict employees’ overtime. For instance, employers may tell employees that no overtime work is permitted or that overtime/double time won’t be paid unless it has been specifically approved in advance.When this occurs and employees still end up working overtime, they will, by law, still be entitled to their overtime or double time pay – regardless of what an employer has stated or the “waivers” an employer has made employees sign.
