A $425,000 settlement will be paid by the Enterprise Rent-A-Car Company of Los Angeles, LLC to end a federal age discrimination lawsuit, the U.S. Equal Employment Opportunity Commission (EEOC) recently announced.

The settlement is part of a three-year conciliation agreement between Enterprise, the EEOC and the 10 job applicants affected by Enterprise’s age discrimination. This agreement specifically requires that, in addition to paying the settlement, Enterprise will have to take steps – such as training employees about anti-discrimination policies – to prevent such age discrimination from happening in the future.

According to the EEOC, Enterprise Rent-A-Car Company of Los Angeles discriminated against job applicants who were 40 or older when hiring for their management trainee positions in their Burbank location. This discrimination, which occurred from 2008 to 2011, ended up affecting 10 job applicants, the EEOC investigation later found.

In fact, while the company tried to argue that it didn’t hire the older applicants because they were not qualified, EEOC investigators ultimately discovered that the older applicants were qualified and that these applicants were passed up for “less qualified, younger applicants, a violation of the Age Discrimination in Employment Act (ADEA).”

Additionally, the EEOC found that “no applicants over 40 years of age [were] hired into the management trainee position at the company’s Burbank office during the three-year period” and that this office had “failed to adequately maintain application records pursuant federal law.”

The EEOC’s Los Angeles District Office District Director, Rosa Viramontes, expressed support for this resolution, noting that, “federal laws request that employers select the best qualified job candidates regardless of age… we are pleased that the local Enterprise Rent-A-Car office agreed to adopt measures to ensure that older job applicants enjoy equal employment opportunities going forward.”
